NOTICE OF INTENT TO AWARD This Funding Announcement is not a request for applications. This announcement is to provide public notice of the National Park Service’s intention to fund the following project activities without full and open competition. New Anticipated Length of Agreement 2 ½ years Anticipated Period of Performance 9/1/2012– 12/31/2014 Award Instrument Cooperative Agreement Statutory Authority 16 U.S.C. §1g CFDA # and Title 15.944 - Natural Resource Stewardship Single Source Justification Criteria Cited Golden Gate National Parks Conservancy (GGNPC) has entered into a Basic Cooperative Agreement to carry out the public purposes of NPS, Golden Gate National Recreation Area (GGNRA) programs. GGNPC is also uniquely qualified to provide this assistance because of the technical assistance provided by professional staff members, potential for cost sharing, ability to utilize membership and outreach networks to assist with public involvement. NPS Point of Contact Nancy Hornor OVERVIEW STATEMENT OF JOINT OBJECTIVES/PROJECT MANAGEMENT PLAN ARTICLE I - BACKGROUND AND OBJECTIVES On October 24, 1997, Cooperative Agreement No. 1443CA8140-98-001 (“Master Agreement”) was entered into by and between the Department of the Interior, National Park Service, Golden Gate National Recreation Area (GGNRA) and the Golden Gate National Parks Conservancy, the (GGNPC). The GGNRA has asked the GGNPC to assist the park in support of planning that is of mutual interest or for which there is collaboration between GGNRA and the GGNPC and which will benefit the public. The GGNRA and the GGNPC are mutually interested in and have determined it necessary to cooperate in a collaborative effort in a variety of alternative transportation planning and public outreach tasks and collaboratively produce planning products including studies, reports, concepts plans, environmental analyses, etc. Anticipated planning tasks involve a sufficient degree of complexity, urgency, and promise to compel a joint effort in order to ensure success. GGNRA staff and GGNPC staff will each bring expertise to the work of the tasks identified in this agreement. GGNPC staff will provide technical expertise, participate in planning and project teams, and bring additional expertise as requested. ARTICLE II – AUTHORITY 16 U.S.C. §1g authorizes the NPS to enter into cooperative agreements that involve the transfer of NPS appropriated funds to state, local and tribal governments, other public entities, educational institutions, and private nonprofit organizations for the public purpose of carrying out National Park Service programs. CFDA number – 15.944, Natural Resource Stewardship ARTICLE III -STATEMENT OF WORK GGNPC agrees to the following: A. Project Objectives and Descriptions GGNRA will collaborate with GGNPC on completing a number of feasibility and resource studies necessary for implementation of Phase Two (2) of the Presidio Coastal Trail, specifically the northern extent of the trail from Merchant Road north to the Golden Gate Bridge. The Presidio Coastal Trail project was approved in the 2003 Presidio Trails and Bikeways Master Plan and Environmental Assessment prepared jointly by the NPS and Presidio Trust. Specific collaborative tasks include but are not limited to the following: GGNPC will work with GGNRA staff to develop scopes of work if soliciting vendors for tasks within this agreement. B. GGNPC shall perform the following tasks: Task 1 - Cultural Resource Compliance (Protection and Preservation): 1a. Archeological investigation within the project footprint: Work will focus primarily on investigating and documenting the possible presence of Battery West within the project footprint. Deliverables: research design/work plan, completed Archeological Sites Management Information System (ASMIS) record form and a report of investigation findings. ($36,700) 1b. Research, documentation and technical assistance to determine historic topography of project site to best identify appropriate measures for restoration of the frontal slopes of the batteries, as well as appropriate trail alignment and construction techniques so as to protect and preserve the historic landscape character. Deliverables; master map and summary report. ($2,900) Task 2 - Geotechnical Investigation and Feasibility Study: Geotechnical investigation, to include preservation of the frontal slopes of the batteries, appropriate trail alignment and stability, and potential solutions within the two known slump areas. Work shall be completed in coordination with the above cultural resource investigations and with NPS natural and cultural resources staff. Deliverable: summary report of findings and recommendations. ($11,800) Task 3 Soils Management Planning at Merchant Road Fill Site: Prepare a Soils Management Plan for contaminated soils associated with the Merchant Road Fill Site at the eastern abutment, as it relates to anticipated grading and construction of the Presidio Coastal Trail and associated bridge over the historic batteries. Deliverable: Soils Management Plan. ($26,600) TOTAL=$78,000 Procurement / Contract Guidelines - Should GGNPC contract out any of the tasks to a subrecipient, GGNPC shall provide the NPS contract specialist with the contractor’s contact information to include DUNS number. Subrecipients are disallowed from participating in any contracted work that results from the work completed in this task agreement. Per 43 CFR 12.943 – “In order to ensure objective contractor performance and eliminate unfair competitive advantage, contractors that develop or draft specifications, requirements, statements of work, invitations for bids and/or requests for proposals shall be excluded from competing for such procurements,” in this task agreement or further task agreements or contracts. GGNRA staff is not allowed to participate in the selection of any subrecipients unless the individual purchase is over $100,000 and additional conditions exist, see 43 CFR 12.944. All procurement and contracting regulations for this task agreement are found under 43 CFR 12.940 – 12.948 to include competition requirements, procurement procedures and contract provisions. GGNPC is required by federal law to follow these guidelines. Quarterly invoicing and reports: 1. Quarterly reports will be provided to GGNRA on October 7, 2012, January 7, 2013, April 7, 2013 and July 7, 2013 to meet the reporting requirements of the Transit in Parks (TRIP) grant. Invoicing will be provided in a timely way to be reflected in the quarterly reporting for the previous quarter. C. GGNRA agrees to: 1. Provide financial assistance as provided for in Article VI. 2. Assist with the formation of and participation on planning and project teams comprised of GGNRA and GGNPC staff that will meet regularly and work collaboratively on the identified planning tasks above, and collaboratively develop project goals and task details. 3. Provide assistance with planning, community outreach and with technical assistance from appropriate and qualified GGNRA and other National Park Service staff. 4. Manage all compliance and public review processes required pursuant to statute, regulation, and National Park Service or GGNRA policy and guidelines, including public meetings, comment, and consultation with appropriate organizations. 5. Provide a timely response to the GGNPC on issues and matters that are presented to the GGNRA for decision or guidance. A. Both Parties Agree and Acknowledge to: A. Create a cooperative partnership to maximize the benefits from the project accomplished by both organizations. B. In partnership plan, design, and engage the community through the coordination of a professional project management team. ARTICLE IV - TERM OF AGREEMENT 1. This task agreement shall become effective upon date of signature and remain in effect through December 31, 2014, subject to availability of funds. 2. This task agreement may be modified by the written mutual agreement of the parties.
