Passive Treatment Protection Program (PTPP)
In accordance with Section 404 of SMCRA, lands and water eligible for reclamation or drainage abatement under Section 404 of Public Law 95-87 (the Act), Stat. 445-532 as amended, are those which were mined for coal or which were affected by mining, waste banks, coal processing, or other coal mining processes prior to August 3, 1977, and left in an unclaimed or inadequately reclaimed condition, for which there is no continuing reclamation responsibility under state or other Federal laws. The funding priorities and technical focus for this announcement are to use appropriated PTPP funds for the comprehensive abatement and treatment of water pollution discharged from abandoned mine lands to restore water quality in streams in a manner that would allow the aquatic biological community to recover. Funding is available to assist local 501(c)(3) status organizations (e.g., watershed groups), organizations using AmeriCorps and its VISTA programs, local governments, tribal governments, and most state government agencies.

Fiscal Year 2023 Funding Opportunities have not yet been posted for this fiscal year. It is anticipated that funding will be made available to assist not-for-profit IRS 501 (c)(3) status organizations (e.g., watershed groups), organizations using AmeriCorps and its VISTA programs, local governments, tribal governments, and most state government agencies. The funding priorities and technical focus for this announcement are to use appropriated PTPP funds for the comprehensive abatement and treatment of water pollution discharged from abandoned mine lands to restore water quality in streams in a manner that would allow the aquatic biological community to recover. Non-Federal entities will use PTPP funds for operation and maintenance costs for new passive treatment systems. Projects may also include repair and renovation of previously installed passive water treatment systems and operation and maintenance costs for existing passive treatment systems.

Applicant Eligibility
Recipients must be not-for-profit IRS 501(c) (3) status organizations. Federal, state, local governments, college, and universities are not eligible to receive direct funding.

Pre-Application Procedure
Preapplication coordination is required. An environmental impact assessment is required for this listing. This program is eligible for coverage under E.O. 12372, "Intergovernmental Review of Federal Programs." Award Procedure
o Applications must be submitted through grant.gov in response to a NOFO. Application will be reviewed as received on a rolling basis. Applications will be reviewed to determine whether they are eligible, complete, and responsive and aligned with the respective program objectives and research grant areas as described in the Program Description. o Applications determined to be ineligible, incomplete, and/or non-responsive based on the initial screening will be eliminated from further review. o Applications that are determined to be eligible, complete, and responsive will proceed for full merit reviews in accordance with the review and selection processes set forth below for each of the respective programs. o At least three objective reviewers, knowledgeable in the subject matter of this NOFO and its objectives, will evaluate each application based on the evaluation criteria o Each reviewer will assign individual scores to each criterion for each application. o The scores provided by each reviewer for each application will then be combined to form a composite score for each application, which serves as the basis for the relative ordering or ranking of applications. o OSMRE may select some, all, or none of the applications, or part(s) of any particular application. o The OSMRE Field Directors or his/her designee approves and awards cooperative agreements for this program.

Reporting
Performance Reports: Cooperative Agreements require substantial involvement in the scope of work and are subject to performance monitoring. Substantial involvement will be limited to one or more of the following areas: (a) Approval of the recipient’s implementation plans; (b) Review of the recipient's monitoring and evaluation plans; (c) Approval of specified key personnel; (d) Concurrence in the substantive provisions of subawards.
Auditing
In accordance with the provisions of 2 CFR 200, Subpart F - Audit Requirements, nonfederal entities that expend financial assistance of $750,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Non-Federal entities that expend less than $750,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in 2 CFR 200.503
Records
Financial records, supporting documents, statistical records, and all other non-Federal entity records pertinent to a Federal award must be retained for a period of three years from the date of submission of the final expenditure ; If any litigation, claim, or audit is started before the expiration of the 3-year period, the records must be retained until all litigation, claims, or audit findings involving the records have been resolved and final action taken, in accordance with 2 CFR Part 200 Subpart D ?200.334.
