States are eligible to receive these funds. In the event that Governors do not apply, other entities, including SEAs, are eligible to receive these funds.

What is the process for applying and being award this assistance?
Pre-Application Procedure
Preapplication coordination is not applicable. Environmental impact information is not required for this program. This program is excluded from coverage under E.O. 12372.
Application Procedure
This program is excluded from coverage under OMB Circular No. A-102. This program is excluded from coverage under OMB Circular No. A-110. The Department will review State applications on a rolling basis. By statute, a Governor may submit an application no later than September 9, 2010. The Department encourages Governors to submit approvable applications as soon as possible so that LEAs may use program funds early in the 2010-2011 school year. The Department anticipates awarding a Stateâ₏™s total Education Jobs Fund allocation within two weeks of the Governorâ₏™s submission of an approvable application.
An approvable application is one that includes:
â₏¢ The Governorâ₏™s assurance that the State will comply with programmatic and fiscal requirements;
â₏¢ The Governorâ₏™s assurance that the State will submit the required maintenance-of-effort (MOE) data to the Department within 60 days of the Stateâ₏™s grant award; and
â₏¢ The LEA distribution method.
Award Procedure
The Secretary of Education will make awards to States on a formula basis upon approval of the State application.
Deadlines
Sep 09, 2010 The Governor of a State must submit an approvable application within 30 days of enactment of the Act. The Department must make awards within 45 days of enactment if the Governor submits an approvable application by the submission deadline. If the Governor fails to submit an approvable application by the submission deadline, the Department may distribute the Stateâ₏™s allocation to another entity or other entities in the State.

How may assistance be used?
Each State may reserve up to 2 percent of its allocation for the costs of administering the program. The State must award the remaining portion of its allocation (at least 98 percent) to LEAs. The Governor may not award funds to entities other than LEAs.
A State may not use program funds, directly or indirectly, to establish, restore, or supplement a rainy day fund, or to supplant State funds in a manner that has this effect. Furthermore, a State may not use program funds, directly or indirectly, to reduce or retire debt obligations incurred by the State or to supplant State funds in a manner that has this effect.
An LEA must use its funds only for compensation and benefits and other expenses, such as support services, necessary to retain existing employees, to recall or rehire former employees, and to hire new employees, in order to provide early childhood, elementary, or secondary educational and related services.
The statute prohibits LEAs from using ED Jobs funds for general administrative expenses or for other support services expenditures as those terms were defined by the National Center for Education Statistics in its Common Core of Data as of the date of enactment of the Act. These prohibited expenses would include administrative expenditures related to the operation of the superintendentâ₏™s office or the LEAsâ₏™ board of education, including the salaries and benefits of LEA-level personnel. Prohibited activities would also include the payment of expenditures for fiscal services, LEA planners/researchers, and human resource services. Further, an LEA may not pay for compensation and benefits of individuals who are not employees of an LEA.

Auditing
In accordance with the provisions of OMB Circular No. A-133 (Revised, June 27, 2003), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that expend financial assistance of $500,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $500,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133. All grantees are subject to the provisions of the Single Audit Act, 31 U.S. Code 75.
Records
The State and its LEAs must maintain records that separately track and account for Education Jobs funds. In accordance with the requirements of Section 443(a) of GEPA(20 U.S.C. 1232f (a)), the State and its LEAs must maintain records that that will facilitate an effective audit and substantiate that the funds were used in compliance with applicable requirements.

Formula and Matching Requirements
Statutory Formula: Sixty-one percent of State allocations will be based on relative shares of individuals aged 5 to 24, and thirty-nine percent will be based on relative shares of total population. The Secretary awards up to one-half of one percent of the appropriated funds to the outlying areas and one-half of one percent to the Secretary of the Interior for schools operated or funded by the Bureau of Indian Education.
