States, U.S. Territories, the District of Columbia, units of local government, and federally recognized tribal governments that were identified as eligible for funding under the Fiscal Year (FY) 2019 State and Local Edward Byrne Memorial Justice Assistance Grant (JAG) Program will be eligible to apply under the Coronavirus Emergency Supplemental Funding (CESF) Program solicitation. Pre-Application Procedure
Preapplication coordination is required. This program is eligible for coverage under E.O. 12372, "Intergovernmental Review of Federal Programs." How may assistance be used?
Funds awarded under the CESF Program must be utilized to prevent, prepare for, and respond to the coronavirus. Allowable projects and purchases include, but are not limited to, overtime, equipment (including law enforcement and medical personal protective equipment), hiring, supplies (such as gloves, masks, sanitizer), training, travel expenses (particularly related to the distribution of resources to the most impacted areas), and addressing the medical needs of inmates in state, local, and tribal prisons, jails, and detention centers. Draw-down - States (or State Administering Agencies) or units of local government may draw down funds either in advance or on a reimbursement basis. To draw down in advance, funds must be placed in an interest-bearing account, unless one of the exceptions in 2 C.F.R. § 200.305(b)(8) apply. It is not necessary that the interest-bearing account be a “trust fund.”. For additional information, see 2 C.F.R. § 200.305.

Formula and Matching Requirements
Statutory Formula: Title 1 Chapter V Part A Subpart 42 USC 3756 Allocation Determination Funds will “be awarded pursuant to the formula allocation … that was used in Fiscal Year 2019” for the Byrne JAG program, “adjusted in proportion to the relative amounts statutorily designated therefor,” except that “the allocation provisions under [34 U.S.C. 10156](a) through (e) and the special rules for Puerto Rico under [34 U.S.C. 10156](g), and [34 U.S.C. 10261](c) … shall not apply.” In principle, award recipients will be states, U.S. Territories, the District of Columbia, units of local government, and federally recognized tribal governments that were eligible for a JAG allocation in FY 2019.
